FOREWORD
The offer and sale of products on the website: www.leciabattine.eu are governed by the following General Terms and Conditions of Sale. In submitting an order, you acknowledge that you have read and agree to the Terms and Conditions described below. Products purchased on the site are sold by Le Ciabattine s.r.l (Supplier) with registered office at Via Bergamo 11 in 20900 Monza e Brianza ITALY, VAT No.: 126270800968, REA No.: MI-2673444. You can contact our customer service department by email: info@leciabattine.eu. Le Ciabattine reserves the right to make changes to these Terms at any time. The Terms and Conditions in effect will be those on the site at the time of your order or at the time you visit the site.
1. BROWSING THIS SITE
The user voluntarily provides personal data by entering it into the dedicated forms such as Create an Account, Checkout as a guest, and the contact form. The user has the possibility to browse the site without releasing any type of personal data. To learn how we process your personal data, visit our Privacy Policy.
2. ORDERS
2.1 Subject
The Offer and sale of products on the website: www.leciabattine.eu implies the implementation of a distance contract governed by Articles 50 ff. of Legislative Decree September 6, 2005, no. 206 (Consumer Code), as well as by Legislative Decree April 9, 2003 no. 70 (so-called Electronic Commerce Law). The purchase of products is intended only for private consumers (Customer).
2.2 How to order
Use a recommended browser that accepts cookies. On our site, to order the products the Customer must:
• visit the online catalog and add the chosen product(s) to the cart. You can access the contents of the shopping cart at any time prior to confirming your order in order to make changes of your choice, where appropriate (in particular, deletion of a selected product or changing the quantity of selected product(s));
• on the product sheet, click on “Add to cart”;
• for new Customers: proceed with registration by clicking on the “Create an account” button or you can proceed without registering as an occasional visitor;
• for those who are already customers: identify themselves using their personal email address and password, confirm with “Log in”;
• enter the delivery information;
• proceed with payment (see point 2.7);
• Once the payment has been validated, Le Ciabattine will send the customer the purchase receipt via e-mail which will contain all the data relating to the order (see point 2.10).
2.3 Acceptance of the order and conclusion of the sales contract
The Customer, by submitting a purchase order, declares that he/she knows and accepts these terms and conditions of sale and additional information contained on the site. The contract will be concluded, and will be binding on both parties, only when the payment is validated and the order confirmation is sent to the customer. Tala confirmation includes the display of a reference code with the details and amount of the purchase. Le Ciabattine reserves the right to change these terms and conditions at any time and replace them with a different version.
2.4 Order cancellation
Le Ciabattine reserves the right not to accept an order in the event that:
1) The ordered product is out of production or unavailable in a short time
2) A change to the product sheet becomes necessary following new regulations.
3) You find an error in the price displayed online or in the product description
4) Items cannot be delivered to the address indicated.
Le Ciabattine reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of an order or for any other reason relating to the abnormal nature of the order, at the discretion of Le Ciabattine. In order to limit fraud and in the interest of customers, The Slippers, conducts checks on orders that are placed on its site. If there is therefore any doubt about the authenticity of the order, Le Ciabattine, in order to accept the sale, reserves the right to ask the customer to justify his or her identity (passport, national identity card or driver’s license with photo), place of domicile and means of payment used. In this case, order processing will be carried out upon receipt of these documents. We reserve the right to cancel an order in the absence of receipt of these items within 10 business days or in the event of receipt of items deemed nonconforming.
2.5 Registration
To proceed with a purchase order, it is best to first register and create your own Customer Profile. This saves your data preparatory to purchase and gives you the opportunity to share our “mission” with participation in promotional events organized by Le Ciabattine. An invitation to be part of our world. However, it remains possible for the customer to proceed with an order even as an occasional visitor (guest). In order to register, the Customer must be eligible to enter into legally binding contracts, have a valid E-mail address, and in order to make payment, have a valid credit card or PayPal account. In completing the registration procedures, the Customer undertakes to follow the directions on the site and to provide his/her personal data correctly and truthfully. Confirmation will in any case exempt The Slippers from any liability regarding the data provided by the Customer or/and unauthorized use by third parties of the customer account. The Customer agrees to promptly inform The Slippers of any changes in their data each time communicated by updating their profile in the specific section within the site. The Customer is responsible for the secrecy and safekeeping of his/her access data and all activities related to his/her account. In submitting an order, the Customer agrees to the use of the site and related transactions (purchase of products) for personal use only, excluding as of now any purpose of a commercial nature or purpose
2.6 Prices
All sales prices of the products on the website www.leciabattine.eu are payable in Euros, inclusive of VAT, but not shipping costs, indicated separately (see point 2.9). They constitute public offerings under Art. 1336 c.c. Note that there is a possibility to vary the final price in case after the order it is necessary to update the tax applied according to Italian regulations (only in case the purchase procedure has not been finalized). Each shipment to France (except Guadeloupe, Reunion Island, Guyana, Martinique, Mayotte, Polynesia), Germany (except Büsingen, Helgoland Islands), Austria, Belgium, Bulgaria, Denmark (except Faroe Islands, Greenland), Spain (except Canary Islands, Ceuta, Melilla, Balearic Islands), Estonia, Finland (except Aland Islands), Great Britain (except Jersey, Guernsey, Isle of Man), Greece (except Mt. Athos), Hungary, Ireland, Italy (except Campione d’Italia, Livigno, San Marino, Vatican), Latvia, Liechtenstein, Lithuania, Luxembourg, Netherlands, Poland, Portugal (except Madeira), Romania, Slovakia, Slovenia, Sweden, Switzerland, Czech Republic is billed inclusive of VAT. All orders are payable in Euros whatever their origin (see Section 2.10).
We accept order requests from EXTRA EU countries, however, it is necessary to send an email to: info@leciabattine.eu. Customs or other local taxes or import fees may be imposed. These fees and amounts are the responsibility of the Customer, they will be indicated to him where appropriate, during the taking of the order.
Our prices are changeable at any time without notice. In any case, items will be invoiced based on the price in effect at the time the order is placed, subject to availability.
2.7 Methods of payment
Payment is always made when the order is placed before the goods are shipped. No discount is granted for early payment. All orders are payable in Euro currency.
At the time of purchase, the customer can choose whether to pay via:
• Credit Card
• PayPal account
For payment by credit card or PayPal Account, the Customer will be redirected to the PayPal payment platform, where he/she can make the payment in secure mode. The PayPal platform directly handles the data entered on its website to make the payment. Le Ciabattine does not collect any data related to the Credit Card used, or related to PayPal payment form access codes. This information is handled directly by the PayPal payment system.
2.8 Tax certification and invoice
Purchases made by Italian and EU Private Customers, are not subject to invoicing under Art. 2 of Presidential Decree 696 of 1996 unless requested by the Customer at the time of placing the order by sending an e-mail with billing information to info@leciabattine.eu, following which they will receive the relevant invoice by e-mail. All customers are emailed a purchase receipt that has the same fiscal and legal value as a traditional receipt.
2.9 Shipping costs
Shipping costs may vary by weight and destination and will be displayed on the page before final payment. A signature is required from the courier upon delivery to ensure the integrity and security of the shipment.
2.10 The delivery
The Slippers reserves the right not to honor an order destined for a country where specific distribution contracts are in place or where specific local regulations exist, informing the customer by email.
The delivery address is the one that was indicated in the order or in your customer profile in the case of registered users. Le Ciabattine cannot be held responsible in the event of non-delivery due to an incorrectness of the data provided by the Customer. Deliveries to a P.O. Box address will not be accepted.
In view of existing restrictions on the transportation of products with alcohol, perfume orders will only be accepted for the following countries: France (except Guadeloupe, Reunion Island, Guyana, Martinique, Mayotte, Polynesia), Germany (except Büsingen, Helgoland Islands), Austria, Belgium, Bulgaria, Denmark (except Faroe Islands, Greenland), Spain (except Canary Islands, Ceuta, Melilla, Balearic Islands), Estonia, Finland (except Aland Islands), Greece (except Mount Athos), Hungary, Ireland, Italy (except Campione d’Italia, Livigno, San Marino, Vatican), Latvia, Liechtenstein, Lithuania, Luxembourg, Netherlands, Poland, Portugal (except Madeira), Romania, Slovakia, Slovenia, Sweden, Czech Republic.
2.11 Delivery time
Products are shipped by express courier, and delivery times to the Customer vary depending on the destination, when the order is acquired, and the availability of the product itself. In any case, however, delivery times will never exceed those stipulated in Art. 6 D.Lgs. 185/99.
Per i prodotti disponibili, dal momento dell’invio della conferma ordine al cliente, salvo imprevisti i tempi di consegna saranno:
• Per le spedizioni in Italia il termine di consegna è dai 3 ai 5 giorni lavorativi. For Puglia, Basilicata, Calabria, Sicily and Sardinia, delivery times will generally be 5 working days. For locations that are difficult to reach such as mountain resorts, smaller islands, extreme suburbs, delivery times may be longer.
– For shipments within the countries of the European Union, Monaco and Switzerland, the average delivery time is 7 working days from order confirmation.
– International shipping (outside Europe) on request: delivery time will be specified according to the final destination. The customer will have to pay any local import taxes.
Please note, these delivery terms are provided as an indication and subject to availability of the items. In the event of a foreseeable postponement of the shipping deadline, Le Ciabattine undertakes to inform the Customer as soon as possible and by any means, in order that the Customer may then choose to maintain or cancel all or part of his order. Le Ciabattine shall not be sued and held responsible for the consequences of events beyond its responsibility, particularly cases of force majeure, or which are the responsibility of the carrier, which tended to delay or prevent the delivery of the products ordered. Under no circumstances may the delivery deadline result in the payment of damages for the benefit of the customer or the customer’s service providers.
2.12 Receipt of goods
Please note that the actual color and/or size of products and any accessories purchased on the site may differ from the actual images on the site used to represent them. Upon receipt of the goods, the Customer must absolutely check in the presence of the courier that the package is perfectly closed, intact, undamaged. Warranty tape is applied to each package to prevent it from being opened and to indicate, if the tape is damaged, any attempts at tampering. In the event that the warranty tape is damaged, the Customer must immediately report the fact to the carrier, accepting the package with specific reservation and completing the appropriate accompanying form indicating where and how the package was damaged. At the same time promptly notify the Customer Service Department of Le Ciabattine via pec: leciabattine@pecimprese.it within the period of 8 working days, providing the order number and your full details. Otherwise the package will be considered regularly delivered.
If the customer is not available at the time of delivery of the order, the courier will leave a notice. The next day will provide a second attempt. If the order cannot be delivered in this case as well, the Customer should contact the courier company as soon as possible to arrange delivery of the order, within a maximum of 2 working days. In order to make delivery without hindrance, the Customer is asked to enter a cell phone number in the delivery data.
3. RIGHT OF WITHDRAWAL
Pursuant to and for the purposes of the Consumer Code (Art. 52 et seq.) as amended by Legislative Decree. n. 21/2014, in the event that an ordered product is defective or does not correspond to the order or in the cases provided for, the Customer has the right to withdraw from the purchase without any penalty and without specifying the reason, within 14 “calendar” days from the date of delivery of the purchased goods, the date as shown on the courier receipt signed by the Customer.
To make use of this right, the Customer shall:
send to Le Ciabattine, within the terms indicated, by registered mail to the address ‘Ufficio Resi Le Ciabattine – based in Via Pietro Nava 7 in 23900 Lecco ITALY or by pec to the address: leciabattine@pecimprese.it,il form “Refund Form” found in the area “My Account” where you should indicate your data, namely Name, Surname, Address, Order Number (indicated in the purchase receipt / invoice), Phone, Description of the product. Upon receipt of such a notice containing an explicit statement of its decision to withdraw from the contract, Le Ciabattine will acknowledge receipt to the Customer.
Thereafter, the Customer must ship, at his/her own expense (art.57) and by a courier of his/her choice, the product(s) he/she intends to return to Ufficio Resi Le Ciabattine – located at Via Pietro Nava 7 in 23900 Lecco ITALY.
Returned goods must be shipped together with the “Return Request” form to Le Ciabattine before the due date (the proof of delivery to the courier will be proof of delivery): 14 days from the date the Customer communicated the withdrawal.
Once the returned goods have been received, Le Ciabattine will proceed, by crediting the credit card used for payment, with a refund relating to the price paid for the product/s for which the right of withdrawal was exercised, within 14 days from the day on which to which the withdrawal decision was received, provided that the goods subject to the withdrawal have been received by the company and comply with the methods specified below:
• Each returned product must be returned intact, with the original packaging complete with all accessories (warranties and everything originally contained) and carefully packaged.
– All risks related to the transportation of the returned product such as the transportation itself are the responsibility of the Customer. In the event of transport damage, Le Ciabattine will notify the Customer within 5 working days of receiving the goods, allowing the customer to take action against the courier used by him. Damaged products will be made available and the withdrawal request will be canceled.
– The customer will be held liable, and therefore not compensable, for opened and/or already used products, for the decrease in value of the goods resulting from handling other than what is strictly necessary to establish the nature, characteristics and functioning of the goods.
Under Art. 59 of the Consumer Code, there is no “right of withdrawal” for products for personal use, sealed. For hygienic and safety reasons, open or already used products cannot be returned.
4. APPLICABLE LAW AND PLACE OF JURISDICTION
The contract between Le Ciabattine and the Customer is governed by Italian law. The Court of Monza and Brianza will have jurisdiction over any dispute between the parties regarding this contract.
